Establishing a Foreign Representative Office (KPJPTLA) in Indonesia is critical for foreign companies looking to enter the country’s electric power services sector.
This guide will explain how to set up a KPJPTLA in Indonesia, including the types of business activities allowed, classification requirements, certification processes, and step-by-step registration.
Purpose of a KPJPTLA
A KPJPTLA allows foreign companies to operate in Indonesia’s electric power sector by engaging in specific activities such as consultation, construction, installation, and maintenance of electrical power installations.
Business Activities for KPJPTLA
You can engage in one or more of these activities, but each activity must be clearly defined and classified when applying for your KPJPTLA. Each subclassification will require separate certification and compliance with specific regulatory standards.
- Consultation in Electrical Power Installation: Providing expert advice on design, implementation, and optimization of electrical power installations.
- Construction and Installation of Electrical Power Installations: Managing the construction and installation of various electrical power infrastructures, ensuring compliance with standards and regulations.
- Maintenance of Electric Power Installations: Conducting routine inspections, repairs, and upgrades to ensure reliability and safety.
Classification and Sub-Classification of Business Activities
Classification and subclassification of business activities are crucial for obtaining the necessary certifications. They identify and categorize the nature of your business operations, which in turn, determines the regulatory requirements you must meet.
| Classification | Sub-Classification |
| Power Plant | PLTU (Coal-Fired Power Plant)PLTG (Gas Turbine Power Plant)PLTGU (Combined Cycle Power Plant)PLTA (Hydropower Plant)PLTMGU (Mini Hydro Power Plant)PLTN (Nuclear Power Plant)PLTS (Solar Power Plant)PLTP (Geothermal Power Plant)PLT EBT lainnya (Other Renewable Energy Power Plants) |

| Electricity Distribution | Distribution network for electricity with medium voltageDistribution network for electricity for low voltage |
| Installation of Electricity Utilization | Installation for high (for large industrial applications)Installation for medium (commercial establishments and smaller industrial setups) Installation for low voltage (residential and small commercial installations) |
Certification Requirements for KPJPTLA
Every sub-classification you apply for must be certified, known as Sertifikasi Badan Usaha (SBU). This certification ensures that your company meets the required standards for operating in Indonesia.
To be eligible for setting up a KPJPTLA, the parent company must have a valid license from its home country for the same classification and sub-classifications it intends to operate. Specific requirements for Indonesian personnel in the KPJPTLA must be met.
Parent Company Requirements
Your parent company must hold a valid license from your home country to operate under the same classifications intended for Indonesia.
Personnel Requirements
For each subclassification, your KPJPTLA must employ personnel with the necessary certifications:
- Chief of Representative Office: Oversees operations and ensures compliance.
- Person in Charge of the Sub-Classification (Penanggung Jawab Utama): Must have a Certificate of Competence (SERKOM).
- Technical Expertise (Tenaga Teknis): Must also have a Certificate of Competence (SERKOM).
Depending on the type of business, you will need to appoint certain number of personnel for your business.
| Type of Business | Chief of Representative Office | Person in Charge (SERKOM) | Technical Expertise (SERKOM) |
| Consultation | 1 | 1 | 3 |
| Construction and Installation | 1 | 1 | 5 |

- Construction and installation work: IDR 100,000,000,000
- Consultancy work: IDR 10,000,000,000
